1. Agreement
These Terms of Use (“Terms”) are a binding agreement between you and mykinkspace.com (“MyKinkSpace,” “we,” “us”). By accessing or using MyKinkSpace, creating an account, or clicking to accept these Terms, you agree to them, our Privacy Policy, GDPR notice, Cookies Policy, and Community Guidelines. If you do not agree, do not use the service.
MyKinkSpace is a free, 21+ social community for adults interested in BDSM, kink, and fetish culture. It is not a dating service, matchmaking service, escort service, or adult-content marketplace.
2. Eligibility
- You must be at least 21 years old. We do not permit anyone under 21.
- You represent that any person depicted in content you upload is at least 21 and has consented.
- You must have legal capacity to enter this contract.
- You may not use the service if you have been banned or if applicable law forbids it.
3. Free service — no fees, no paid features
MyKinkSpace is provided free of charge. We do not sell subscriptions, credits, boosts, or paid matches. You owe us nothing to use the service, and we owe you no paid support, uptime, or results.
4. Your account
You are responsible for your account, password, and everything done with it. Keep credentials confidential. Notify us at privacy@mykinkspace.com if you believe the account is compromised. We may refuse, suspend, or delete accounts at any time, with or without notice, including for guideline violations or inactivity.
5. Your content
You keep ownership of content you post (text, photos, profile information, messages, and similar). You grant MyKinkSpace a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate, secure, and improve the service, including showing it to people you choose via your privacy settings.
You represent that you have all rights needed to post the content and that it does not violate law or these Terms.
We may remove, hide, or refuse content at our discretion. We are not obligated to monitor the service but may do so for safety, legal, and operational reasons.
6. Acceptable use
You will not:
- Post, request, or share sexual content involving anyone 17 or under, or anyone who appears to be a minor.
- Post non-consensual intimate imagery, revenge porn, hidden-camera content, or doxxing.
- Harass, threaten, stalk, traffic, coerce, or exploit anyone.
- Use the service for prostitution, solicitation of illegal sex work, or trafficking.
- Impersonate others, scrape the service, spam, or reverse-engineer the platform.
- Interfere with security, access others’ accounts, or overload our systems.
- Treat MyKinkSpace as a dating, hookup, or matching service we operate — any socializing is between users.
Consent, negotiation, and risk-aware play are your responsibility. The platform does not verify kink experience, STI status, or identity beyond tools we choose to offer (such as optional verification badges).
7. Adult content; 18 U.S.C. § 2257
The service contains adult sexual discussion and imagery uploaded by users. We are not the “producer” of user-generated content for 18 U.S.C. § 2257. Users who upload depictions of actual sexually explicit conduct are solely responsible for required records. By uploading, you certify that every person depicted is 21 or older and that you keep any legally required identification records.
8. Other people; in-person meetings
Hang-outs, events, messages, and profiles are user-to-user. We do not arrange dates, screen members for criminal history, or supervise meetups. If you meet anyone in person, you do so entirely at your own risk. Use your own judgment, public places, and trusted safety practices. We are not liable for anything that happens between users online or offline.
9. Privacy
How we handle personal data is described in the Privacy Policy, GDPR notice, and Cookies Policy. You control visibility settings, but no online service is perfectly private. Do not post information you cannot afford to have copied or leaked.
10. Intellectual property
The MyKinkSpace name, logo, layout, and software are ours or our licensors’. You may not copy the platform or use our marks without permission. If you believe content infringes your copyright, write privacy@mykinkspace.com with a complete DMCA notice (identification of the work, the material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized).
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” FREE OF CHARGE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, secure, accurate, or error-free, or that content or members are trustworthy.
12. Limitation of liability — $0
BECAUSE THE SERVICE IS FREE, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE, THESE TERMS, OR YOUR USE OF MYKINKSPACE IS ZERO U.S. DOLLARS ($0.00), TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITY; PERSONAL INJURY; EMOTIONAL DISTRESS; DEFAMATION; OR ANY INTERACTION WITH OTHER USERS, WHETHER ONLINE OR IN PERSON — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
Some places do not allow certain exclusions. In those places, our liability is limited to the greatest extent permitted, and if a court requires a dollar amount despite the service being free, that amount will not exceed fifty U.S. dollars ($50.00). Nothing in these Terms limits liability that cannot legally be limited, such as liability for fraud or for death or personal injury caused by our proven negligence where such a limit is forbidden.
13. Indemnity
You will defend and indemnify MyKinkSpace and our people from claims, damages, and costs (including reasonable attorneys’ fees) arising from your content, your use of the service, your meetings with other users, or your breach of these Terms or the law.
14. Termination
You may stop using the service and delete your account in settings where available, or by emailing privacy@mykinkspace.com. We may suspend or terminate access at any time. Sections that should survive (including 5, 7–13, 15–17) will survive.
15. Changes
We may change the service or these Terms. Continued use after an update means you accept the new Terms. The “Last updated” date at the top is the effective date.
16. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration. Courts in Dallas County, Texas have exclusive venue for disputes not subject to arbitration, unless applicable consumer law requires otherwise.
17. Dispute resolution
Before filing a claim, email privacy@mykinkspace.com and wait 30 days. Except for IP claims or claims that may be brought in small-claims court, disputes will be resolved by binding individual arbitration under the AAA Consumer Rules. Class actions and class arbitration are waived to the extent permitted by law. You may opt out of arbitration within 30 days of first agreeing to these Terms by writing privacy@mykinkspace.com with subject “Arbitration opt-out.”
18. Miscellaneous
These Terms are the entire agreement about the service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. Headings are for convenience only.
